What Do We Need in Order to Advise You?

At the very least, we need to see the decision paperwork issued to you at the ICB. If you instruct us to prepare your initial written argument as part of the Local Disputes Resolution process with the ICB, we will need to see the outcome letter and a full copy of the Decision Support Tool (DST).

If you’re later in the process and are ready to ask NHS England to convene an Independent Review Panel, we need to see the original decision outcome letter and DST. We will also need all paperwork that has been issued by the ICB as part of the continuing healthcare funding appeal. For example, this may include a further decision letter and a report following the Local Disputes Resolution meeting.

In retrospective cases, you may also have a Needs Portrayal Document to provide to us. Or you may have obtained care home and/or medical records, which we can also take into account.

Whilst preparing your appeal submission, we may decide that further evidence should be obtained to support your appeal.

If you’re instructing us to prepare your written healthcare funding appeal submission and we are not acting on your behalf, then the written appeal submission will be lodged with the NHS by you.

It can also be very helpful for you to tell us in writing of any concerns or observations you have about decision the ICB has reached, so that we can take this into account when providing our advice.
