A man who used a mobility scooter because he could not afford to run a car, has been banned from driving after crashing the scooter through a shop window.

Darren Wells was banned from driving for 17 months and fined more than £400 after mistaking the scooter’s reverse gear for the forward gear and smashing into the window. He was over the drink-drive limit at the time but the case rested on whether the scooter was regarded as mechanically propelled under the Road Traffic Act 1998 and whether Wells qualified to drive one under the Chronically Sick and Disabled Persons Act.

The Magistrates Court said it was satisfied that Wells had not been using the scooter in accordance with legislation and passed the sentence. As well as the ban and the fine he will also have to undertake a drink driving awareness programme.
