Legislation changes 'same roof rule'
Historic abuse suffers can now claim compensation, as the government has finally changed the leglistlation.
What period of time can I claim for?
If you suffered historic abuse between 1964 and 1979, you may have been told you could not claim compensation because you lived under the same roof as the abuser. This rule has been in place for years and unfairly prevented many victims of historic abuse from receiving compensation.
There was a Court case in July 2018 which found in favour of victims of such abuse, but we’ve been waiting for the government to pass legislation amending the rule. That day has finally arrived, as since today, 14.3.19 the CICA scheme which contained that unfair same roof rule has been amended. The specific rule has been totally removed, and there are now new rules on how to bring such a claim. The important one, is there is a short window of opportunity to claim, so you should obtain expert advice as soon as you can.
