A 64-year-old grandfather has lost a compensation claim for unfair dismissal and age disability and discrimination.
Gary Johnson was dismissed from his job as parts manager at Colmore Cars in the West Midlands having worked for the business for 17 years. He was suspended and then dismissed from his job having given a customer the phone number of a former employee. The management of the firm alleged that he had given the number so that the customer could get his car serviced at a cheaper rate than was available through Colmore Cars.
Mr Johnson told Birmingham Employment Tribunal that he believed he had been “set up” in the phone call and that the company wanted him replaced to make way for a younger man who would be paid less in a bid to save costs. Tribunal judge Alan McGarry said that there was no evidence to support Mr Johnson’s compensation claims and he said the set-up allegations were an elaborate concoction.
