The High Court has refused to order an injunction to restrain an employee from using or disclosing confidential information, despite the existence of a confidentiality agreement. The court also declined to impose a "barring order" on the employee. This case is a reminder that, in practice, the only way for an employer to protect the information which he wishes to protect is, in many cases, by including a restrictive covenant in the contract of employment.
