Is the patient resident in England

Yes

You may have a claim, but Winston Solicitors do not currently act in Continuing Healthcare claims outside of England.

Is the patient currently in hospital?

Yes

In the majority of cases, a Continuing Healthcare assessment should take place after discharge from hospital, when the patient's long-term needs are better understood.

You may wish to contact us again for support with an application for NHS Continuing Healthcare once the patient has been discharged from hospital with a suitable package of care.

If a Continuing Healthcare assessment has been agreed to be undertaken for a patient in hospital, we may be able to offer you support with the eligibility assessment. See our legal representation page for more information.

Has the patient's eligibility been assessed within the last 12 months?

Yes

If the patient's eligibility for Continuing Healthcare Funding has already been assessed within the last 12 months, it may be too early to apply unless the patient's needs have changed.

You usually have six months to appeal a decision of ineligibility, or a decision to withdraw Continuing Healthcare Funding. If you're still in time to appeal, and wish to do so, the starting point is to instruct us to advise you on the merits of the appeal.

What contribution does the patient make towards their care fees per week?

You may have a claim, but it may be disproportionate for Winston Solicitors to act for you due to the potential value of the funding award.

You may wish to contact charitable organisations for support, such as Age UK.
