For many survivors of childhood abuse, seeking justice can be a long and painful process. John’s story, though deeply distressing, demonstrates that even when the criminal courts do not deliver the outcome a survivor hopes for, the Criminal Injuries Compensation Authority (CICA) may still provide an alternative path to recognition and financial support.

John* endured ten years of physical and sexual abuse at the hands of his mother’s partner, beginning at the age of nine. The abuse took place in his own home, a place where he should have been safe. It wasn’t until he was in his forties that he felt strong enough to report the crimes to the police. After an arduous five-year investigation, the case went to trial. It resulted in a not guilty verdict, which was devastating for John.

Although the court case didn’t end in a conviction, John learned that he could still apply for compensation through the CICA. Unlike a criminal court, which requires proof beyond reasonable doubt, the CICA applies a different standard known as the ‘balance of probabilities’ test. This means that if the available evidence indicates that it is more likely than not that the crime occurred, compensation may still be awarded.

The Challenges of Navigating a CICA Claim

Determined to seek acknowledgment of the abuse he had suffered, John began the application process with the CICA. However, he soon realised that navigating the system alone was more stressful and complex than he had anticipated.

“I did extensive research before starting my claim, but the process was overwhelming,” John explains. “Once you begin on your own, you quickly realise how deep the rabbit hole goes, encountering many unexpected issues. Without expert advice, it's easy to get lost in the system. Winston Solicitors was the first firm willing to take on my case after I'd started, and handing it over to professionals was a huge relief.”

Overcoming the Time Limit Barrier in Childhood Abuse Cases

One of the initial hurdles in John’s case was that he had submitted his claim outside the usual two-year time limit. However, the CICA can exercise discretion in cases of historical childhood abuse. Particularly when claimants can demonstrate that trauma or other factors prevented them from coming forward sooner. With legal expertise from our experts, John was able to overcome this barrier and proceed with his claim.  

After reviewing his case, the CICA initially offered John an award of approximately £23,500. While this sum acknowledged the abuse he had suffered, it failed to reflect the full impact of his trauma, particularly the severe and lasting effects on his mental health and ability to work.

John had suffered from significant mental health issues as a result of the childhood abuse, including PTSD, anxiety, and depression. However, these consequences were not adequately accounted for in the CICA’s initial offer. Recognising the need to challenge this, we gathered crucial medical evidence to support John’s case.

Strengthening the Childhood Abuse Claim with Medical Evidence

One of our CICA Experts, Heidi Stewart, worked closely with John’s mental health treatment providers to obtain the necessary evidence.

A psychiatrist’s report was commissioned, which confirmed that John’s mental health condition was directly linked to the abuse he suffered as a child. Furthermore, the report concluded that his condition was severely disabling and would continue to be so on a permanent basis.

John recalls:

Securing the Right Compensation

Once we provided clear evidence that John met the CICA’s criteria for a permanently disabling mental health condition, they were able to pursue a much larger claim that included loss of earnings. The psychiatrist’s report established that John had been unable to work due to his condition and was unlikely to be able to return to employment in the future.

As a result, John’s final award was increased to over £250,000, reflecting not just the childhood abuse he had suffered, but also the long-term consequences on his health and financial stability.

A Message of Hope for Other Childhood Abuse Survivors

Receiving such a significant sum brought new considerations. We advised John on how to manage his compensation effectively. This included exploring the option of setting up a trust fund and ensuring his financial security through proper estate planning.

John’s story highlights that, even when the criminal justice system does not lead to a conviction, survivors can still seek justice through alternative means. CICA claims can be challenging, but with the right legal support, survivors can secure the recognition and compensation they deserve.
